Last year, the FTC issued a final rule banning the use of most non-compete agreements (with exceptions, such as those selling a business). A federal district court said the rule was unlawful because it exceeded the FTC’s rulemaking authority. The FTC moved to dismiss an appeal of this decision. But this doesn’t mean the FTC is okay with all non-compete agreements. The FTC now has a task force looking into various issues, including non-compete agreements.
