California requires businesses with 5 or more employees to enroll them in the California Choice Retirement Savings Program if the businesses don’t have their own qualified retirement plans. The validity of the program was upheld by a federal appellate court. Now, the U.S. Supreme Court refused to hear an appeal, allowing the court’s position to stand and these plans to be valid. Other states, including Colorado, Connecticut, Illinois, New York, and Oregon, have similar programs; there are different rules and effective dates in these locations.
