Speak Out Act Bans Certain NDAs

Congress passed the Speak Out Act, which prohibits the use of prospective, pre-dispute non-disclosure and non-disparagement agreements (i.e., agreements before the unlawful conduct). These NDAs would otherwise prevent employees from discussing workplace sexual harassment or sexual assault. This federal law is similar to state laws enacted in a number of states, including California and Illinois. #IdeaoftheDay
