The DOL announced a proposed rule to determine whether joint employer status exists. The rule uses a 4-factor test, considering whether the employer actually has the power to (1) hire or fire the employee, (2) supervise and control work schedules or conditions of employment, (3) determine the rate and method of employee payment, and (4) maintain employees’ employment records. Comments to the proposed rule can be made through June 10, 2019.
