Under a proposed rule change by the NLRB to amend the “voluntary recognition bar,” unions will not be able to prevent employees from decertifying them using a claim of election interference. Employees who no longer want union representation can move to decertify a labor union by having at least 30% of employees sign a petition. A 60-day comment period for the proposed change began on August 12. It is unclear whether or when a final rule will go into effect.
