Under a final rule announced on April 1, 2024, and which becomes effective today, employees may designate a non-employee third party as their representative during an OSHA inspection. This rule is called the worker workaround representative designation process. The rep doesn’t have to have any special credentials. FYI: This rule was strongly opposed by business groups that expressed concerns, including the fact that there’s no process for employers to object to these third parties and employers may have to provide the reps with personal protective equipment during the inspection.
