Obesity Not a Disability

That’s the conclusion of an appellate court with respect to a case about discrimination under the Americans with Disabilities Act (ADA). A machinist was denied work and claimed his high BMI was the reason, and that this was discriminatory. The court said that denying employment because of obesity itself is insufficient to show a violation of the ADA; a worker must show that obesity caused some physical or mental impairment that severely affected major life functions.
