If your business engages temporary workers through an agency, you may have to provide certain information to the agency…if you’re in New Jersey. A Temporary Workers’ Bill of Rights seeks to ensure temps are paid similarly to permanent employees for comparable work. Under a proposed rule effective August 5, 2023, the client engaging a temp worker must provide the service firm with the hourly rate of pay and cost per hour of benefits of each employee that it determines is a “comparator employee” (someone similarly situated). The protections for temp workers apply to those with a temp assignment in New Jersey, or an assignment outside the state if the worker lives in New Jersey.
