The National Labor Relations Board (NLRB) rule for joint-employer status, which was supposed to take effect on December 26, 2023, was delayed until today. The rule is based on the alleged joint employers’ authority to control essential terms and conditions of employment, whether or not such control is exercised, and without regard to whether any such exercise of control is direct or indirect. Seven factors are taken into account for this purpose.
