Independent Contractor Status for NLRB Purposes

Employees can unionize; independent contractors cannot. The National Labor Relations Board (NLRB) recently overruled (click on The Atlantic Opera, Inc.) a 2019 decision that had “entrepreneurial opportunity” as the lynchpin for independent contractor status. So, now the independent contractor test uses entrepreneurial opportunity as merely one factor. #IdeaoftheDay
