The DOL withdrew the final rule on independent contractor status under the Fair Labor Standards Act that had become final on January 6, 2021, and was set to take effect on March 8, 2021. That rule used an “economic reality” test to determine worker classification; a worker economically dependent for work would be treated as an employee. At this time, it is unclear what test to use.
