In January, the U.S. Department of Labor (DOL) issued a final rule that rescinded the rule in effect since 2021 and replaced it with a new rule. The new rule applies a 6-factor test. This rule applies for the purpose of determining whether a worker is subject to minimum wage and overtime pay rules. It does not apply for purposes of federal employment taxes.
