You do if you’re located in Washington, DC. Today, a new rule effective today requires employers with at least 20 employees to offer transit benefits if the employee spends at least 50% of his or her time working in DC or is based in DC, performs a substantial amount of work in DC, and less than 50% in any other state. Severe penalties can result for employers that fail to comply. Similar rules are already in effect in New York City and San Francisco.
