Consumer Credit Report Protection for Contractors?

The Fair Credit Reporting Act (FCRA) gives employees certain protections when consumer credit reports are used for “employment purposes.” However, several courts have decided this protection does not apply to independent contractors. For example, a district court in a case involving a real estate agent who was not engaged as an independent contractor following a negative credit report, said the FCRA protections relate to “employment;” they don’t apply to independent contractors.
