That’s what a New Jersey court told an employer that was sued by an employee who alleged a failure to receive notice about COBRA eligibility when she left the company. The employer argued that the severance agreement was sufficient notice for COBRA, but the court said no and refused to dismiss the case. While the severance agreement mentioned COBRA, it did not provide enough of the required COBRA notice information. It’s possible that a severance agreement could be sufficient as long as it contains all the requisite information for a COBRA notice. #IdeaoftheDay
