When a couple who own a business together split up, dividing up the ownership of the business and other assets is complicated. If there’s an ESOP, use extra care. In one case, the transfer of a spouse’s vested interest in the ESOP disqualified the ESOP. A divorce decree dissolving a marriage is not sufficient to allow the transfer of plan assets.
