California enacted the ABC test for determining whether a worker is an employee or independent contractor. An association of owner-occupied commercial drivers challenged the constitutionality of the law, which makes it harder for workers to be classified as independent contractors, on the grounds the test violates the Commerce Clause of the U.S. Constitution. A federal appeals court has upheld the law, saying the ABC test doesn’t violate the Constitution.
