Ban on non-competes effective today?

The FTC’s ban on non-compete agreements is scheduled to go into effect today in most of the country. The FTC’s ban was temporarily enjoined by a district court in Texas, but this is not a nationwide ban. The U.S. Supreme Court’s decision this past June in the Loper Bright case may be a basis for future lawsuits to upend the FTC ban on the grounds that the FTC doesn’t have the authority to issue such a ban.
