A final DOL rule expands the exemption from overtime rules under the Fair Labor Standards Act for employees in certain retail or service establishments that work primarily on commission. Previously, there had been lists of what did or did not constitute retail or service establishments, but the final rule eliminates them. This change, which experts suggest is favorable to employers because it expands businesses that can qualify, applies as of May 19, 2020.
