Several localities, including San Francisco, CA, Miami Beach, FL, and Madison, WI, have laws barring discrimination for job applicants and employees based on height and weight. New York City enacted such an ordinance on May 26, 2023. Under this ordinance, an employer’s decisions based on height and weight won’t be considered discriminatory if these factors prevent job performance or are reasonably necessary for normal business operations.
