Title VII bars employees from discriminating against employees on the basis of race, color, religion, sex, or national origin. A federal appellate court, in a case involved a heterosexual employee who claimed she was denied promotion in favor of a gay employee, imposed a requirement of showing “background circumstances” by straight employees proving sexual discrimination. The U.S. Supreme Court unanimously said that both straight and gay employees have the same challenge in proving discrimination; the background circumstances rule is out. #IdeaoftheDay
