The Kansas Supreme Court held that FedEx Ground drivers are employees, despite the company’s independent contractor agreement with them. The court said: “[I]f a worker is hired like an employee, dressed like an employee, supervised like an employee, compensated by an employer, and terminated like an employee, words in an operating agreement cannot transform that workers’ status into that of an independent contractor.” This case follows the same results reached in a decision by the Federal 9th Circuit Court of Appeals.
