A final rule from the Department of Labor under the Family and Medical Leave Act defines spouses to include same-sex spouses who are married in a state recognizing such unions (“state of celebration”). This includes marriages validly entered into outside the U.S. The new rule took effect on March 27, 2015. FMLA applies to employers with 50 or more employees.
