That’s the conclusion of the Tax Court in a recent case. In order to take a home office deduction, you must use the space regularly and exclusively for business. But minor or incidental use (the taxpayer here had to walk through the home office space to get to her bedroom area in her 700 sq. ft. NYC studio apartment) is not fatal to the deduction.
