The use of marijuana is legal in 23 states for medical purposes and in 4 states plus D.C. for recreational purposes, with legislation pending to legalize its use in other states. While income from such businesses is taxable, deductions are restricted because marijuana is still a controlled substance under federal law. However, the IRS says businesses can subtract the cost of goods sold.
