Last year, an appellate court reversed the Tax Court and held that federal Conservation Reserve Program (CRP) payments to a non-farmer were excluded from net earnings for purposes of self-employment tax. Now the IRS has nonacquiesced to this decision. Similar taxpayers located in circuits other than the Eighth Circuit will have to litigate if they want to avoid self-employment tax on CRP payments.
