If they do, the employer can be liable for back overtime pay and liquidated damages. Recently LinkedIn paid nearly $8 million in unpaid overtime wages and damages to 359 employees as a result of a Department of Labor investigation. The company did 2 things wrong: It didn’t pay for “off the clock” time, which is an all too common, though illegal practice, and it didn’t keep accurate time and payroll records.
