A sole proprietor, whose business’ 401(k) plan was victimized by a third party administrator who embezzled funds, was required to make up any unrecovered plan funds to avoid a DOL case against him for breach of fiduciary duty. The IRS said the payments were an ordinary and necessary business expense separate and apart from plan contributions for prior and current years.
